Terms of Use
This is a translation for your convenience. If in doubt, the German version applies. Deutsche Fassung
Draft. These terms only apply once the evenings and letters start.
1. Who we are
mitmensch.net is run by Kevin Blumenstock, Leopoldstr. 34, 10317 Berlin, Germany (details in the Imprint). In these terms, “we” means the operator.
The principles of mitmensch.net (What we stand for) are part of these terms. Acting against the principles described there means acting against these terms.
2. What mitmensch.net is – and what it is not
mitmensch.net is a leisure offer for meeting other people: people write letters to one another and sit together at campfires.
mitmensch.net is not therapy, counselling or a support service. It does not replace medical, psychotherapeutic, psychological, legal or other professional help. Firekeepers, guests and members do not act as professionals in this sense.
If you are not doing well or are worried about someone: in Germany, TelefonSeelsorge is there for you around the clock, free and anonymous, on 0800 111 0 111 and 0800 111 0 222 or at telefonseelsorge.de. Elsewhere, findahelpline.com lists free support in your country. In an emergency, call 112 (in the EU) or your local emergency number.
3. Membership
You set up your access yourself. This creates a contract of use between you and us.
mitmensch.net is for people aged 18 and over. By signing up, you confirm that you are at least 18.
Whatever you do on your own is free: sitting at the fire alone and writing letters just for yourself. For rounds with others you need something you buy beforehand: wood for an evening at the campfire, a stamp for every letter that is delivered. We tell you the price beforehand. If a partner invites you to a round, it can be free for you.
4. Campfires
Campfires are small conversation rounds. They take place live, with voice only. Guests without a membership can also take part; the principles apply to everyone. By joining a campfire, you agree to these terms and the principles.
Campfires with a firekeeper. These evenings are opened and accompanied by Kevin Blumenstock as firekeeper, often together with an invited guest. This means: we open the round, remind everyone of the principles and hold the space. In case of breaches we may mute participants or remove them from the round. This is not supervision, not counselling and no guarantee that everyone will follow the principles. Guests speak for themselves.
No recordings. We do not record campfires. Participants may not record campfires either – no audio, no video, no screenshots – and may not pass on who said what. Chosen names and portrait pictures are only shown during the session and are not stored.
No advertising. Nobody uses a campfire to promote themselves, their own offers or anyone else, and nobody sells anything.
If something does not feel right, you may leave a campfire at any time without explanation. You can also report incidents afterwards (§ 7).
5. Your content
You keep all rights to what you write or say. You only grant us the rights we need to provide the service in question – for example to store, check and deliver a letter. We only pass your content on to the technical service providers named in the Privacy Policy.
6. Our content
Texts, design, illustrations, code and the mitmensch.net brand are protected and belong to us unless stated otherwise.
Any use beyond the intended use requires our prior consent.
7. Reports and our decisions
You can report letters, incidents at campfires and other content that you consider illegal or that breaches the principles: by email to hello@mitmensch.net. Please describe what happened and why, in your view, it is not okay. We confirm receipt and handle reports promptly, carefully and impartially.
If we restrict content or access – for example by not delivering a letter, removing someone from a round or blocking an account – we tell the person concerned what we did and why, as far as this is possible without endangering others. You can then object by email; we will look at the decision again.
We do not fully check content posted by other people in advance. If we learn of illegal content, we act without delay (Art. 6 DSA).
8. Ending your membership
You can end your membership at any time, informally by email to hello@mitmensch.net.
We can block or end an account if someone breaches these terms or the principles. In serious cases – for example threats, harassment or recordings against the will of others – this happens without notice, otherwise with reasonable notice and a reason.
9. Liability
We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.
In case of a slightly negligent breach of an essential obligation – an obligation whose fulfilment makes the use of mitmensch.net possible in the first place and on which you may rely – we are only liable for foreseeable damage typical for this kind of contract. Otherwise our liability is excluded as far as the law permits.
People are themselves responsible for what they write or say in letters or at campfires.
10. Availability
We do our best to keep things running smoothly, but we cannot promise constant availability. Maintenance, faults or outages at our service providers can temporarily limit access.
11. Changes to these terms
If these terms change, we will email you at least four weeks in advance and clearly set out the changes. Significant changes – for example a fee or new obligations for you – only apply if you expressly agree to them. If you do not agree with a change, you can end your membership at any time.
12. Final provisions
German law applies. If a provision is invalid, the remaining provisions stay valid. Information on dispute resolution can be found in the Imprint.
